Fight Against Rape




On the night of 16th December 2012,  the heinous crime that took place in the country's capital, Delhi moved the entire nation. A girl was brutally gang raped inside a bus plying the road and then, She was left to die on the street.Thousands took to the streets demanding justice for the girl. They demanded justice for the girl who courageously fought for her life. We don't know the girl's name either caste nor religion, but for millions of Indians, she was like a sister, daughter and a friend. Every heart was aching for her. There was a public outcry to end violence against women. The public resentment forced the Government machinery to step in. The public agitation was successful.After some days, culprits were arrested. But our prayers couldn't save her.

The cruelty, brutality and callousness with which this revolting act was committed highlighted the criminals belief that they won't be convicted, that they would escape, easily. Just the way rapists, more often than not escape being convicted. But this incident brought about a change in the country. The people, especially the youth.

I would like to share some of statistical graph of rape cases in the year 2012, the courts of our nation had 1,01,041 cases of rape are pending. Among this the whole year, the rapists convicted were 3,563. In 11,446 cases, the accused were acquitted, and the other 86,032 cases are pending in courts. This indicates that only in 3.5 percent of the cases, accused are convicted. This only comprises those cases which have reached court. Many rape cases don't even get reported. If the unreported cases are included, this figure will reduce to less than one percent. This makes one thing very clear, In India, rapist hold the upper hand.

Rapists in our country are holding the upper hand. Counting of rape cases is increasing day by day. Many people often say, due to hot clothes men's are attracted and they lost their control. My research revealed is shown is graph; I want to inform you that, 10% of a girl wearing frock because they were 3-7 years old girls.

So, it's not connected anywhere related to clothes. The females from 2 years- 93 years of age heave been raped till now.

The three aspects of our system which a rape victim can easily get justice. According to my research, one thing has emerged in malfunctioning of our system, i.e., POLICE, MEDICAL and JUDICIARY.

Police System

A police station is the first place of the rape victim and her family approaches. In order to get justice and security. My research highlighted the fact that the police attitude is often inappropriate

This declaration made in a police station.I hereby want to share my documentary script related to this topic which is amongst true events. Let's see how rape victims have been treated in a police station.
In the rape and kidnap case of 11 years old girl, the police kept her in a lock-up, for six days. They threatened her that if she didn't testify as told, her father, brother and mother would be killed. They tied her without giving any food and water too.

The attitude of the police towards a victim is too harsh. We all have seen in the script, how the victims are all treated by police.Instead of fulfilling their duty, they try to find out faults against the victim.So, our police behaviour is harsh towards rape victim, it is a very shocking and disgraceful thing for our nation.

Medical System 

A woman needs foremost apart from the police is hospital and attention of the doctor. There are two reasons to this. Firstly, the women would have suffered many physical injuries that need to be treated. And secondly, the proof gathered during the medical examination, plays an important role in getting the rapists convicted.

In the medical system, conditions are terrible, even worse than a police station. Doctors behave as if she is not a victim, but the accused. These cases are so sensitive that maintaining confidentiality is very crucial. A rape incident as a mere police case, but it has a serious medical implication. There is a possibility of HIV infections, the injuries could cause an infection, pregnancy too is the possibility and mental trauma too needs medical attention. A medical book states that rape victim should be viewed with suspicion. It also been stated that, a male doctor is examining the victim, must be cautious because the victim could also accuse the doctor of rape, so wrong learning is given to MBBS students.Most importantly, a hospital does not follow any set of procedure for the rape examination. There's not even a standard procedure for examination in our medical system.

So this wrong learning is given for MBBS students, and thy don't even have proper training and procedure for examination of rape victims. Our medical system needs much improvement as per as possible.

Judiciary

A place where we hope to get the justice. There's a partiality amongst the victim and accused.The public prosecutor meets the victim in court for the first time when she comes to testify. That's when she's required to reveal the details of the rape. The accused has all the papers regarding the case, but the victim is not in a possession of the papers. Even, the victim doesn't know what police have recorded, her testimony accurately which she gave to them during FIR. She doesn't get the copy of that. So when she goes to the court after few years to testify she could not able to recollect the statement to the police. After a statement is recorded if the recorded statement is not shown to the complainant, how would the complainant know what has been recorded? So, due to such reasons accused may goes scot-free.

So it is important that the statement recorded by the police should be shown to the complainant, get it approved and she should get a copy. I believe that until the focus of the criminal case is on the accused, the discrimination will prevail. The system needs to focus largely on the victim. The case should be complainant - centric. Our judiciary system is also getting worse and worse day by day, again shameful aspect for our nation.

So, Police, Medical and Judicial system, these were the three aspects of approach for every rape victim. Rapid improvement is required for these three aspects our system, if the improvement happens, then only rape victim should get justice easily.

 So friends, we really need to understand something, we may criticize our system and find many faults in it but to a great extent is the system is formed from our mindset.If I, you and all of us, as a society blame the women for a crime like rape, stay away from her, taunt her, try to cast her out of the society and think that she's been dishonoured, then in a way we are supporting the rapists. If the society decides, rather than the victim they would make the rapist's life miserable, he will be ostracized and dishonoured, then there will be no way of rapists to hold the upper hand.

Those committing this crime would be less than one percent. Yet, they are able to defeat the overwhelming majority. They are the one who should be afraid before committing a crime. But, isn't it a joke that we are the one who are scared? From the time she's born till, she breathes her last every woman live in fear. From the time, he's born till his last breathes every man lives in the fear that such an incident might occur with his daughter, wife sister, mother or friend. And it's very unfortunate that all of us have compromised with this fear. Who are we afraid of? And why should I live my entire life in fear? Why do those one per cent people hold the upper hand? We all need to bring about change, and the thing will change when the culprit know that he will definitely be punished. And it won't take 10-15 years, in fact, he will be punished in a couple of months. The condition of nation changes, when the people of that country awaken themselves. When they bring about the changes in themselves and tell their government, the administration and system that they are not prepared to take it anymore, that when things change.

    3. A gender-sensitive, scientific and humane protocol for the medical examination of survivors of rape, to be uniformly implemented across the country.
